Washington Supreme Court Strikes Down I-2066
State litigation ends, but broader energy-choice challenges continue
The Washington Supreme Court has struck down Initiative 2066 in a 6-3 decision, ruling that the measure violated the state Constitution’s single-subject requirement.
Washington voters approved I-2066 in November 2024. The initiative addressed access to natural gas service and energy choice for homes, businesses, and communities across the state.
The decision concludes the state court challenge to I-2066. BIAW expressed disappointment with the ruling and raised concerns about its implications for the citizen initiative and legislative processes. The association also noted that legal challenges involving natural gas access and consumer energy choice remain active elsewhere in the country.
For builders and other housing professionals, the ruling is an important development in Washington’s evolving energy, building-code, and affordability landscape.
